Events Terms & Conditions

These terms and conditions (“Terms”) govern your participation in the event to which these terms link (the “Event”) hosted or co-hosted by Monday Girl. These Terms constitute the entire agreement between you and Monday Girl relating to the matters set forth herein, and supersede all prior or contemporaneous understandings, agreements, negotiations, representations and warranties, and communications, both written and oral. 

In exchange for your participation in the Event, you agree to these Terms. Monday Girl reserves the right to change or modify these Terms at its sole discretion at any time without notice to you. Monday Girl also reserves the right to change or modify the Event at any time without notice to you. 

Any personal information Monday Girl collects from you will be used by Monday Girl only for the purposes for which it was collected and will be held by Monday Girl in confidence and stored and processed in accordance with applicable privacy laws and its privacy policy. You represent and warrant that you have the right to disclose such personal data to Monday Girl.

The Event, including without limitation, any information, materials and participating speakers are provided without warranties of any kind, expressed or implied, including without limitation, any implied warranty, representation, or condition of merchantability, merchantable quality or fitness for any purpose.  

Monday Girl assumes no liability whatsoever (including without limitation, direct, indirect, special, exemplary, punitive or consequential damages) whatsoever, whether known or unknown, which you have or may have in the future have arising out of or in connection with your attendance and participation in the Event and the information and/or materials provided during the Event.  

You may also be referred to third parties before, during or after the Event. You acknowledge that Monday Girl has no liability (including without limitation, direct, indirect, special, exemplary, punitive or consequential damages) whatsoever, whether known or unknown, which you have or may have in the future in connection with those third parties services or benefits you may or may not receive.

You acknowledge that you may be photographed. You also acknowledge that video recordings and/or voice recordings of you may be made during the Event. You hereby give consent to Monday Girl, its successors, assigns and licensees to use your name, image, photo, likeness, voice, actions or other like information, in whole or in part, individually or in conjunction with other images in a video to be prepared by Monday Girl or a third party in connection with the Event (the “Video”). You further give consent to Monday Girl the right to reproduce, use, exhibit, broadcast, display and distribute such Video in any media now known or to be developed and the right to create derivative works in connection with such Video (“Derivative Works”). 

You acknowledge that Monday Girl owns all intellectual property rights in the Video and any Derivative Works.  In connection with the Video and the Derivative Works, you hereby waive: (a) all moral rights; (b) any royalties or other form of remuneration; and (c) the right to approve same. 

You hereby release Monday Girl, its successors, assigns and licensees from and against all claims, liabilities, demands, actions causes of actions, costs and expenses at law or in equity, which you ever had, or may have in connection with your participation in the Event, your use or reliance on any information or materials you may receive in connection with the Event and your consent and waiver in connection with the Video and any Derivative Works.  

Monday Girl owns all right, title and interest in and to its website and its trademarks, service marks, and trade names are proprietary to Monday Girl or its affiliates and/or third party licensors.

If you provide 48 hours notice or more prior to the Event, Monday Girl will provide a refund for your registration fee.  For clarity, you will not receive a refund if you cancel your participation within 48 hours of the Event.

These Terms shall be governed by, construed and enforced in accordance with the laws of the Province of Ontario and the federal laws applicable therein and the parties irrevocably attorn to exclusive jurisdiction and the venue of the courts in the Province of Ontario, Canada.  Any provision of these Terms that is prohibited or unenforceable will be ineffective to the extent of the prohibition or unenforceability without invalidating the remaining provisions.
